Martine Lavergne-Fefer, psychologue du travail, livre ses conseils.<\/em><\/p>\n<p><strong>Qu\u2019appelle-t-on \u00ab harc\u00e8lement moral \u00bb au travail ?<\/strong><\/p>\n<p><strong>Martine Lavergne-Fefer<\/strong> : \u00ab Il s\u2019agit de la r\u00e9p\u00e9tition d\u2019actes ou d\u2019injonctions portant atteinte \u00e0 la sant\u00e9 physique ou morale d\u2019une personne, lesquels d\u00e9gradent l\u2019estime de soi \u00e0 travers une culpabilit\u00e9 et une perte de confiance. Le reconna\u00eetre peut s\u2019av\u00e9rer complexe car le harc\u00e8lement est parfois involontaire, lorsqu\u2019un manager est lui-m\u00eame soumis au stress, par exemple. La prise de conscience de cette violence morale est tr\u00e8s d\u00e9licate car elle d\u00e9pend aussi de la confiance en soi des victimes. Certains salari\u00e9s se sentent en effet harcel\u00e9s s\u2019ils ont des objectifs difficiles \u00e0 atteindre et que cela g\u00e9n\u00e8re une forte anxi\u00e9t\u00e9. Des signes aident toutefois \u00e0 reconnaitre cette situation : violences verbales, crises de larmes de personnes harcel\u00e9es, absences r\u00e9p\u00e9t\u00e9es, turn-over, accidents du travail fr\u00e9quents, tensions dans l\u2019\u00e9quipe \u00bb.<\/p>\n<p><strong>Comment r\u00e9agir ?<\/strong><\/p>\n<p><strong>M L.F<\/strong> : \u00ab Dans tous les cas, il ne faut pas rester seul : en parler, c\u2019est acter qu\u2019il y a maltraitance ou management violent. Il est important de se faire aider, en contactant le m\u00e9decin du travail, les syndicats, un psychologue, l\u2019inspection du travail. Il faut le signaler au manager lorsque cela provient d\u2019un coll\u00e8gue. Et surtout, il peut s\u2019av\u00e9rer n\u00e9cessaire de garder des traces (mails, t\u00e9moins\u2026) pour le prouver \u00bb.<\/p>\n<p><strong>Comment faire lorsque le harc\u00e8lement est exerc\u00e9 par une personne prise en charge ?<\/strong><\/p>\n<p><strong>M L.F<\/strong> : \u00ab C\u2019est toute la difficult\u00e9 du sanitaire et social. Ces professionnels ont souvent choisi cette carri\u00e8re par envie d\u2019aider, par empathie. Mais, face \u00e0 certaines situations qui ne s\u2019arrangent pas, ils peuvent se sentir impuissants, sentiment qui peut conduire au stress, voire au burn out, si l\u2019on surinvestit sa vie professionnelle au d\u00e9triment de sa vie personnelle, dans un contexte de surcharge d\u2019activit\u00e9, de surcroit. Si on est harcel\u00e9 par une personne dont on est cens\u00e9 prendre soin, on est d\u00e9chir\u00e9 entre sa mission et une forme de culpabilit\u00e9 de ne pas y arriver, une perte d\u2019estime de soi. Dans ce genre de situation, \u00e0 chacun de trouver la limite de ce qu\u2019il peut accepter. D\u00e8s lors qu\u2019elle est franchie, il faut en parler avec sa hi\u00e9rarchie et \u00e9changer avec ses coll\u00e8gues \u00bb.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>Que dit la loi ?<\/strong><\/p>\n<p>Le harc\u00e8lement moral au travail constitue un d\u00e9lit en France depuis l\u2019adoption de la loi de modernisation sociale du 17 janvier 2002 qui l\u2019a introduit dans le code du travail, le code p\u00e9nal et au sein du statut de la fonction publique.<\/p>\n<p><strong>\u27a2<\/strong> Deux types d\u2019actions sont possibles en cas de harc\u00e8lement moral :<\/p>\n<ul>\n<li>Saisine du conseil des prud\u2019hommes, pour obtenir r\u00e9paration du pr\u00e9judice subi. La victime devra pr\u00e9senter des preuves directes ou indirectes de ce harc\u00e8lement, dans un d\u00e9lai de cinq ans apr\u00e8s le dernier cas de harc\u00e8lement. La proc\u00e9dure a lieu contre l\u2019employeur (pour licenciement abusif s\u2019il est l\u2019accus\u00e9), m\u00eame si ce n\u2019est pas l\u2019auteur direct du harc\u00e8lement : il sera alors jug\u00e9 pour ne pas avoir prot\u00e9g\u00e9 son salari\u00e9 contre le harc\u00e8lement<\/li>\n<li>Saisine de la justice p\u00e9nale : La victime peut porter plainte dans un d\u00e9lai de six ans \u00e0 partir du fait le plus r\u00e9cent de harc\u00e8lement. La justice prendra alors en compte tous les faits de harc\u00e8lement venant du m\u00eame auteur.<\/li>\n<\/ul>\n<p><strong>\u27a2<\/strong> Deux types de sanctions peuvent se cumuler, celles de l\u2019employeur et celles de la justice :<\/p>\n<ul>\n<li>L\u2019employeur : mutation, mise \u00e0 pied voire licenciement<\/li>\n<li>La justice : jusqu\u2019\u00e0 2 ans de prison et 30 000 \u20ac d\u2019amende<\/li>\n<\/ul>\n<p>L\u2019auteur de harc\u00e8lement moral peut aussi \u00eatre condamn\u00e9 \u00e0 verser des dommages-int\u00e9r\u00eats.<\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>Comment reconna\u00eetre le harc\u00e8lement ?
