Contrairement au CDI, le Contrat \u00e0 Dur\u00e9e D\u00e9termin\u00e9e doit obligatoirement \u00eatre conclu par \u00e9crit et comporter certains \u00e9l\u00e9ments. Voici une liste des principaux points \u00e0 conna\u00eetre sur ce contrat de travail.<\/p>\n<p><span style=\"font-size: medium;\">Le motif<\/span><\/p>\n<p>L&#8217;objectif du CDD est d&#8217;occuper des t\u00e2ches temporaires dans un \u00e9tablissement. C&#8217;est pourquoi, le motif du recours \u00e0 ce contrat de travail doit \u00eatre imp\u00e9rativement pr\u00e9cis\u00e9\u00a0par \u00e9crit. Parmi les motifs l\u00e9gaux, on peut citer :<br \/>\n&#8211; l&#8217;emploi saisonnier<br \/>\n&#8211; l&#8217;accroissement temporaire d&#8217;activit\u00e9<br \/>\n&#8211; l&#8217;absence ou le d\u00e9part d&#8217;un salari\u00e9.<!--more--><\/p>\n<p><span style=\"font-size: medium;\">La dur\u00e9e<\/span><\/p>\n<p>La date de d\u00e9but du CDD\u00a0doit figurer sur le contrat, mais il n&#8217;y a pas d&#8217;obligation concernant la pr\u00e9sence de la date de fin. \u00c0 d\u00e9faut, la dur\u00e9e du CDD ou la p\u00e9riode \u00e0 laquelle il devrait se terminer peut-\u00eatre mentionn\u00e9e (exemple : la date de fin peut co\u00efncider avec le retour de cong\u00e9 du salari\u00e9 qui \u00e9tait remplac\u00e9).<\/p>\n<p><span style=\"font-size: medium;\">La rupture du CDD<\/span><\/p>\n<p>La p\u00e9riode d&#8217;essai est de deux semaines maximum pour les CDD de moins de six mois, et d&#8217;un mois pour les CDD de plus de six mois.<br \/>\nAu terme de celle-ci, le contrat \u00e0 dur\u00e9e d\u00e9termin\u00e9e ne peut \u00eatre rompu qu&#8217;en cas de faute grave ou avec l&#8217;accord de l&#8217;employeur et du Salari\u00e9. Par cons\u00e9quent, il est en principe impossible de d\u00e9missionner d&#8217;un CDD. Une exception existe\u00a0cependant. Si le salari\u00e9 trouve un emploi en CDI, sa d\u00e9mission du CDD lui sera valable.<\/p>\n<p><span style=\"font-size: medium;\">Le renouvellement<\/span><\/p>\n<p>Un CDD peut \u00eatre renouvel\u00e9 une fois, mais la dur\u00e9e totale ne doit pas d\u00e9passer 18 mois. Par ailleurs, un poste ne peut \u00eatre occup\u00e9 par deux CDD successifs que si\u00a0l&#8217;employeur respecte un d\u00e9lai de carence \u00e9gal au tiers de la dur\u00e9e totale du pr\u00e9c\u00e9dent CDD.<\/p>\n<p><span style=\"font-size: medium;\">La prime de pr\u00e9carit\u00e9<\/span><\/p>\n<p>Au terme du CDD, l&#8217;employeur est dans l&#8217;obligation de verser une prime de pr\u00e9carit\u00e9. Son montant est de 10% de la r\u00e9mun\u00e9ration brute per\u00e7ue durant la totalit\u00e9 du CDD.
